Terms and Conditions
scope
The “General Terms and Conditions for Services by Chantal Hofmann Design (CHE-331.509.152) based in Staufen” (“GTC”) apply unless there are different regulations for a service.
Prices
All prices are in Swiss francs (CHF). Additional expenses will be charged at an hourly rate of CHF 90.00.
The amount for the layout creation, prototype or sample printing is also to be paid if the order is cancelled.
Initial meetings are free. If further meetings are required, the expenses incurred will be charged at an hourly rate of CHF 90.00.
The purchase of any image and font licenses is at the expense of the customer.
terms of payment
Invoicing takes place by e-mail or by post. The invoice amount is to be paid within 30 days of the invoice date.
Chantal Hofmann Design reserves the right to advance payments.
If the customer has neither paid the invoice in full by the due date nor raised objections in writing and with reasonable grounds, he is automatically in default. In the event of a delay, Chantal Hofmann Design can interrupt the provision of all services and take further measures to prevent increasing damage and/or terminate the contract without notice or compensation.
In the event of default, a flat rate of CHF 50.00 and any collection efforts will be charged.
retention of title
The delivered products remain the property of Chantal Hofmann Design until full payment has been made.
Delivery / shipping costs
Deliveries (parcels) are sent by registered mail (SI) to the address provided by the customer. Use and risk are transferred to the customer as soon as the ordered goods have been handed over to the post office for dispatch. The customer therefore bears the transport risk.
Shipping:
· Letter delivery A-Post: CHF 2.00
· Parcel shipping, Priority, registered (SI): CHF 20.00
The specified shipping costs include packaging material, shipping preparation and postage.
Collections at the Chantal Hofmann Design headquarters can be arranged by arrangement.
defects
The customer is obliged to check the delivered goods and to inform Chantal Hofmann Design in writing within 3 days of any defects due to transport.
Claims for damages due to late delivery are excluded.
For orders that are made according to the customer's specifications and/or are tailored to personal needs, the customer receives a PDF file before each print order in the sense of "OK to print". The customer carefully checks this "OK for printing" and confirms with the written print approval that he acknowledges the "OK for printing" and bears the responsibility for any defects such as incorrect illustrations or texts. Reprints are at the expense of the customer.
refund policy
There is no right to return goods that are made according to the customer's specifications.
copyright
The copyright for the paper products made by Chantal Hofmann Design lies with Chantal Hofmann Design. Chantal Hofmann Design has the right to use a design created on customer request for further orders from other customers. Digital designs and ready-to-print files that are sent to the customer belong to Chantal Hofmann Design and may not be used by the customer for their own use or passed on to third parties. Chantal Hofmann Design may use the design and execution without restrictions, both during the development process and after completion. Chantal Hofmann Design attaches great importance to the confidential treatment of personal data. Private information is anonymized and not made accessible to third parties.
production / manufacture
The customer provides Chantal Hofmann Design with digital images and texts.
Minor inaccuracies can occur in both manual and machine production within a production. In the event of the following deviations, neither a replacement delivery nor a credit for printed products and services will be made:
· Color differences to the view on the screen
· 1-2 mm difference in fit and size
· Minimal cutting and folding tolerances
Liability
The liability of Chantal Hofmann Design for consequential damages, loss of profit, damages are - as far as legally permissible - excluded in any case. Liability for damage resulting from slight negligence is excluded.
Chantal Hofmann Design is not liable if the provision of the service is limited or impossible due to force majeure.
Governing Law/Jurisdiction
The contract is subject to Swiss law. Place of jurisdiction is 5603 Staufen, Switzerland.

These general terms and conditions (hereinafter GTC) apply to the online shop at www.chantalhofmanndesign.ch (hereinafter online shop). The operator of the online shop is: Chantal Hofmann Design, Kulmerweg 18a, 5603 Staufen (hereinafter referred to as the provider).
The provider may change these terms and conditions at any time. The version of these GTC applicable at the time the contract is concluded is decisive. Deviating conditions of the customer are not recognized.
General
The offer is aimed exclusively at people residing or having their registered office in Switzerland. Shipping is only to addresses in Switzerland.
The pictorial representation of the products serves as an illustration and is non-binding.
shipping
The dispatch takes place with the Swiss Post. Envelopes are sent by A Mail, parcels by B Mail. The customer's delivery address must be easily accessible for the delivery service, otherwise the customer bears the additional costs resulting from the delivery.
It is at the discretion of the provider whether the order is sent in one or more packages or as a letter.
Availability
The offers in the online shop are non-binding and should not be understood as binding offers. The information on availability and delivery time is given without guarantee and can change at any time.
Prices
The prices are net in Swiss francs. The shipping costs are charged additionally and are to be borne by the customer. VAT is not charged, Chantal Hofmann Design is currently not subject to VAT.
The shipping costs, which are shown in the shopping cart, are calculated separately.
The provider reserves the right to change the prices published in the online shop at any time. The price at the time of the order is decisive for the purchase price.
conclusion of contract
If the customer orders an article in the online shop, he submits an application for the conclusion of a purchase contract to the provider. Once the application has been received by the provider, the customer will receive an automated confirmation of receipt. This confirmation does not yet represent acceptance of the application by the provider and does not contain any promise that the item can actually be delivered. The purchase contract is concluded when the provider confirms the order and issues the invoice to the customer.
Shipping
The exact shipping costs are calculated during the ordering process depending on the order and displayed in the shopping cart.
Obligation to test and give notice of defects
If the ordered goods are delivered with obvious transport damage, the customer must complain to the delivery service immediately and refuse acceptance. Transport damage must be reported to the provider.
The customer checks the goods for completeness, correctness and damage immediately after receipt. The customer must report defects within 5 days of receipt. In this case, he may not put the goods into operation and must keep the original packaging. If the complaint is recognized by the provider, the customer must follow the provider's instructions for the return.
refund policy
There is no right to return purchased items.
payment
The customer must make the payments in Swiss francs. The following payment options are available to the customer:
Credit card, prepayment
The items delivered by the provider remain the property of the provider until full payment has been made. The provider is entitled to make an entry in the retention of title register.
Disclaimer
The provider is not liable for slight negligence, for consequential damage, for indirect damage, for lost profit or for the actions of his assistants.
privacy
The processing of personal data is regulated in the separate data protection declaration www.chantalhofmanndesign.ch/datenschutz. This is part of these terms and conditions.

Jurisdiction and Applicable Law
This contract is subject to Swiss law to the exclusion of the United Nations Convention on the International Sale of Goods (UN Sales Convention).
The following exclusive responsibilities are agreed for all disputes arising from this contract:
In the case of a complaint by a consumer, the ordinary courts at the domicile or habitual residence of the consumer or at the registered office of the provider shall have jurisdiction.
In all other cases, the jurisdiction of the ordinary courts in Staufen is agreed.
